Is mortgage-to-cash the correct route?

This service is intended for a property sale where:

  • A mortgage is registered against the seller’s property
  • The seller requires the mortgage to be settled as part of the sale
  • The buyer is purchasing without mortgage finance
  • The completed sale will be registered through a DLD-authorised trustee centre

This may not be the correct route if the buyer also requires mortgage finance, the seller will independently discharge the mortgage before the transaction, the property is company-owned, or the proposed transfer is a gift rather than a sale.

What we coordinate

Route and document review

We identify the registered mortgage, confirm the buyer’s cash-funded position and review the property, identity and transaction documents before the bank and trustee sequence begins.

Bank liability coordination

The seller’s bank must confirm the outstanding mortgage liability and its settlement requirements. We coordinate the liability-letter requirement, validity period and applicable bank instructions so the transfer is prepared against a current settlement figure.

Mortgage settlement preparation

The transaction may require separate payment instruments for the bank liability, the balance payable to the seller and the applicable DLD charges. We coordinate the settlement schedule with the parties and trustee centre. Conveyance.ae does not receive or hold the mortgage-settlement amount or purchase money.

Mortgage release coordination

Once the applicable liability amount has been settled through the official process, the seller’s bank must complete its procedures and issue or register the required mortgage release. We track this dependency and coordinate submission of the release evidence required to complete the ownership transfer.

Developer inspection and NOC coordination

Some developers require a pre-NOC property inspection, particularly for villas, to identify unauthorised alterations, extensions or other departures from the approved property record. Where required, we coordinate and attend the developer’s inspection, follow any procedural requirements and coordinate issuance of the developer NOC.

Trustee registration and title deed

We coordinate the applicable trustee appointments and remain with the file through mortgage release, sale registration and issuance of the buyer’s new electronic title deed.

Additional documents may be required where the mortgage is connected to a developer payment plan, a party is acting under a power of attorney, the property is jointly owned or one of the parties is outside the UAE.

From bank liability to new title deed

Open the transfer file

You provide the transaction details and appoint Conveyance.ae. Documents may be supplied immediately or after the file has been opened.

Confirm the route

We verify that a mortgage is registered against the seller’s property and that the buyer is purchasing without mortgage finance.

Establish the liability

The seller obtains a current liability letter from the bank or other applicable funding entity. We review its amount, validity and settlement instructions against the proposed transaction.

Prepare the wider file

The sale documents, identity records, developer inspection and NOC requirements, payment schedule and trustee requirements are coordinated.

Prepare the mortgage settlement

The applicable bank-liability payment, seller balance and DLD payment arrangements are prepared in the form required for the official transaction.

Register the protected transaction

The parties attend the applicable DLD-authorised trustee process. The payment allocated to the mortgage liability is handled through the official procedure so the seller can complete the bank’s release requirements.

Complete the mortgage release

The seller’s bank completes its discharge procedures and provides the required mortgage-release confirmation.

Complete the sale registration

Once the release is accepted and the remaining requirements are satisfied, the mortgage release and sale are completed and the buyer receives the new electronic title deed.

The working timeframe depends on the seller’s bank, liability-letter validity, mortgage-release processing, developer requirements and the availability of the parties. Conveyance.ae cannot control a bank or authority’s processing time.

Official registration

DLD and the seller’s bank remain authoritative.

Conveyance.ae prepares and coordinates the transaction around the applicable Dubai Land Department and bank procedures. The seller’s bank determines its liability and mortgage-release requirements. The official mortgage release and ownership transfer are completed through the applicable bank, DLD and authorised trustee processes.

Conveyance.ae is an independent service operated by Cendale Documents Clearing Services FZCO. It is not part of Dubai Land Department or the seller’s bank and cannot override their requirements or processing decisions.

Plain answers before you appoint us.

What does mortgage-to-cash mean?
It means the seller has an existing mortgage registered against the property and the buyer is purchasing without mortgage finance. Part of the purchase-price settlement is used to discharge the seller’s mortgage before the ownership transfer can be completed.
Why is a liability letter required?
The liability letter confirms the amount outstanding to the seller’s bank and provides the information required to prepare the mortgage settlement. Liability letters normally have a limited validity period, so the wider transaction must be coordinated around the current letter.
Does the buyer pay the seller’s bank directly?
The amount allocated to the mortgage liability is prepared and handled according to the applicable bank, DLD and trustee procedure. Any remaining purchase-price balance is dealt with separately. We provide the transaction-specific settlement schedule once the liability and trustee requirements have been confirmed.
Does Conveyance.ae hold the purchase money?
No. Conveyance.ae does not receive or hold the property purchase price or mortgage-settlement money. Settlement follows the applicable bank and DLD-authorised trustee process.
Is the property transferred before the mortgage is released?
DLD’s mortgaged-sale procedure protects the transaction while the bank liability is settled. Final completion depends on the required mortgage-release confirmation being submitted and accepted.
What if the liability letter expires?
The seller may need to obtain an updated liability letter before the transaction can proceed. We monitor the validity period when arranging the settlement and registration sequence.
What if the mortgage liability is higher than expected?
The transaction must be reviewed against the confirmed purchase price and the amount required by the bank. Any shortfall must be resolved before the standard transfer sequence can proceed.
Is a developer NOC still required?
The developer NOC remains a separate property-transfer dependency where applicable. The developer may also require service-charge clearance, documentation or a property inspection before issuing it.
Does the service include a property inspection?
Where the developer requires a pre-NOC compliance inspection, Conveyance.ae can coordinate and attend it as part of the transfer process. The inspection is conducted by or on behalf of the developer and may check for unauthorised alterations or extensions. It is not a structural survey, snagging inspection or independent assessment of the property’s condition.
Can the seller discharge the mortgage before the sale?
Yes. If the seller independently settles and releases the mortgage before the transfer file proceeds, the eventual transaction may follow the simpler cash-to-cash route instead.
How long does a mortgage-to-cash transfer take?
There is no responsible single timeframe. The sequence depends particularly on the seller’s bank, the validity of the liability letter, mortgage-release processing, developer requirements and trustee availability. We confirm the working sequence after reviewing the transaction.
Can the transfer proceed if one party is outside the UAE?
Potentially, but the route depends on the party’s circumstances and whether a valid power of attorney or an approved remote procedure can be used. This must be established before the appointments are arranged.
Are bank, DLD and trustee fees included in AED 6,999?
No. AED 6,999 + VAT is the Conveyance.ae professional fee. Bank, DLD, trustee, developer and other official or third-party charges are separate.
