Cancellation
Cancellation is ending a registered property contract. DLD cancels contracts on a court decision, and off-plan contracts can be terminated under set rules.
Definition
DLD’s Contract cancellation application cancels a sale, mortgage or lease-to-own contract “based on a resolution issued by Dubai courts”, and asks for “A letter from Dubai Courts”. For off-plan sales, Law No. (19) of 2020 sets the rules where a purchaser fails to fulfil his obligations, letting the developer retain up to 25% or 40% of the unit value depending on project completion. DLD’s FAQ states it “does not have the authority to terminate any contract between the developer and the investor” at the investor’s request.
What it shows — and what it does not
Who can cancel, and on what terms, depends on the contract and the law. A buyer wanting to end an off-plan contract cannot ask DLD to do it.
Example
Illustrative example: after a court rules that a sale contract is cancelled, the court’s letter is submitted to DLD and the contract is cancelled on the register.
