Ownership-status checks before a Dubai property transfer

Before building the transfer file, identify who is recorded as owner, who is authorised to act and what change is intended. These preparation checks help expose missing evidence; they are not a legal opinion or a certificate that a property is free of every risk.

Work through five separate questions

Do not use a positive answer in one column to assume the others are settled.

Begin with the actual record

Obtain the relevant current title or provisional-registration evidence and reconcile it with the agreement. Use the official title-verification process where applicable.

If the seller supplies Oqood evidence for an off-plan resale, identify that route explicitly. Read Oqood versus title deed before treating the records as interchangeable.

Establish the authority chain

For an individual acting personally, check the identity against the record. For a representative, identify the accepted authority for the acts required. For an entity, bring together the company’s current information and the evidence supporting the relevant approval and signatory.

Disclose name changes, dissolved entities, disputed authority or a document issued for another purpose. A short explanation of the history is more useful than hiding it behind a generic “company transfer” label.

Identify known constraints early

Ask about mortgage status and any known restriction or dispute affecting the proposed transaction. Record the answer and the evidence that must be obtained from the responsible organisation. Do not assume that the absence of a problem in one supplied document proves no other issue exists.

Match the checks to the service scope

Conveyance coordinates procedural preparation within the agreed appointment. Legal title due diligence, advice on beneficial ownership, corporate powers, inheritance, disputed rights or investment consequences may require a qualified adviser. Make that appointment separately where needed.

Turn uncertainty into a specific action

Write “entity name differs between title and current licence; confirmation required from the relevant issuer” rather than “documents pending”. A specific statement identifies both the evidence gap and the next task.
